Terms of Service for the Bump Networks application Birthday Elephant

General information

1.1 Bump Networks, offers based on these Terms of Service (TOS) the free use of an mobile phone software application ("Birthday Elephant"). Birthday Elephant ("BE") is an application that allows users to automatically send birthday greetings to their Facebook friends.

1.2 Bump Networks is entitled to amend BE and its specific functions and conditions at any time.

1.3 These TOS shall apply exclusively. Conditions that stand in the way of or deviate from these TOS shall not be recognized unless Bump Networks has expressly consented to their validity. This shall also apply if Bump Networks carries out the service unconditionally in the knowledge of conditions that oppose or deviate from these TOS.

Limited License

2.1 Your use of the BE application constitutes a non-exclusive, non-transferable, revocable, limited license to access and use the BE application pursuant to the Terms of Service listed herein.

2.2 Bump Networks reserves the right to terminate this license at any time for any reason.

Acceptance of Terms

3.1 Bump Networks provides a limited license for you to use the BE application subject to the following Terms of Service, which may be updated by Bump Networks from time to time without notice to you.

3.2 By accessing and using the BE application, you accept and agree to be bound by the terms and provisions of these Terms of Service. If you do not accept and abide by these Terms of Service, you may not use the BE application.

Proper use

4.1 You agree that you are responsible for your own communications and for any consequences thereof.

4.2 You agree that you will use the BE application in compliance with all applicable local, state, national, and international laws, rules, and regulations, including any laws regarding the transmission of technical data exported from your country of residence.

4.3 You shall not, shall not agree to, and shall not authorize or encourage any third party to: (i) use the BE application to upload, transmit, or otherwise distribute any content that is unlawful, defamatory, harassing, abusive, fraudulent, obscene, contains viruses, or is otherwise objectionable as determined by Bump Networks in its sole discretion; (ii) upload, transmit, or otherwise distribute content that infringes upon another party's intellectual property rights or other proprietary, contractual, or fiduciary rights or obligations; (iii) prevent others from using the BE application; or (iv) use the BE application for any fraudulent or inappropriate purpose. Violation of any of the foregoing may result in immediate termination of your account and may subject you to state and federal penalties and other legal consequences. Bump Networks reserves the right, but shall have no obligation, to investigate your use of the BE application to determine whether a violation of the these Terms of Service has occurred or to comply with any applicable law, regulation, legal process, or governmental request.

Payment

5.1 The use of BE shall be performed free of charge.

5.2 You may not resell or otherwise use BE as part of a commercial offering.

Liability

6.1 Bump Networks shall be liable according to the statutory provisions for claims that can be assigned to it due to injury to life, body and health and damages according to the Product Liability Act; for damages that are caused by intentional or fraudulent behaviour.

6.2 In other respects all forms of liability on the part of Bump Networks shall be excluded.

6.3 A contributory negligence on the part of the user shall be credited against the amount of the potential compensation claim.

6.4 The user is obliged to immediately notify Bump Networks or have the details recorded by Bump Networks of potential claims as defined by the above liability regulations ensuring that Bump Networks is informed as soon as possible and can potentially still reduce the scope of the damage in cooperation with the user. Termination of the contract

7.1 Both parties to the contract can terminate a contract at any time without stating the reasons. The user can submit their declaration of termination directly by deleting the BE application or deauthorising it from their Facebook account.

7.2 The termination shall become effective immediately following the termination of the performance. The termination by the user shall become effective two working days after the submission of the declaration of termination.

Bump Network's Privacy Policy for Birthday Elephant (BE) is designed to provide clarity about the information we collect and how we use it to provide a more fun experience. By accepting our Privacy Policy and Terms of Service during connection to your facebook account, you consent to automating Birthday greetings to your facebook friends.

Introduction

BE helps you NEVER to forget your friends. Once you connect it to your Facebook account it will say "happy birthday" from you - automatically - even if your phone is off or you don't have signal - or even if you are in another country.

We take privacy issues very seriously and we do NOT collect any information from you or your friends aside from checking people's birthdays - so we know when to say Happy Birthday to them.

Information We Collect

The only piece of information we know about any user on our system is their date of birth.

How We Collect Information About You

We collect your birthday also (from facebook) - so other people can say Happy Birthday to you when your time comes.

How We Use the Information We Collect

We use the information to help people say "Happy Birthday!" to each other ;)

We do not share the information separately from accepted Facebook practices (e.g. writing on your friends' walls)
